Well, the simple answer can be found in The Formula (vide Fight Club.)
The cost to settle potential /individual/ suits is less than paying you
all according to the law. My brother the lawyer reffers to this practice
as 'the efficient tort'... which he also believes is /wrong/... (as
opposed to the 'efficient breach' where a contract is not honored but
since it doesn't cost anyone anything, nobody cares.)
This sort of behavior is commonplace, and only rarely does it blow-up in
a company's face. Last one I can remember making news was the
tire-blowout problem on Ford Explorers. Less widely known is Microsoft's
willfull violation of their consent degree involving illegal ties within
their product line. This costs MS a million dollars a day for each day
they are in violation, which they gladly pay as the illegal advantage
gained is greater than that.
Now that said... I am NOT an authority, so please be polite when you
inform me I'm wrong. :)
