I wouldn't use it either, but for different reasons. It seems to unfairly make hardened notches more desirable.  Hardened notches are better than failed ones, but not as good as having no notches at all (as I read it), so to give advantages in addition to not making checks would seem to require stronger disadvantages to go along with it.  Also, other hardened notches would need to have similar advantages for any sort of 'balance', which could be worked out, (if balance is even a concern.
