Given that most of the drug statutes are federal, it makes sense that the
feds would be incarcerating a greater percentage (in other words, a rape,
unless it were done in a federal context--in a state park, or on a military
base, or within certain set criteria), would most certainly be handled by
local, ie state authorities. Most states are willing to kick drugs up to a
higher level, simply because a lot of the drug trade involves interstate
trafficking, creating messy jurisdictional matters, and the Feds can get a
lot more nasty when provoked.
Now when I read this, I inserted "harm" instead of "time," which is
understandable, given that I was just getting off of work, dealing with the
true victims of these so-called victimless crimes. But since you were just
interested in the easier question to answer, there you go.
